What is Leave Travel Allowance?
Leave Travel Allowance (LTA), often referred to as Leave Travel Concession (LTC), is a benefit offered by employers to employees to cover travel expenses incurred during their leave.
According to Section 10(5) of the Income Tax Act, in conjunction with Rule 2B of the Income Tax Rules, this allowance can be exempt from tax if certain conditions are fulfilled.
Who is eligible to claim LTA?
This exemption is exclusively available to salaried employees who receive LTA as part of their salary structure. Employees whose salary packages do not include this component typically cannot claim the exemption. The travel must also occur during the employee’s leave period.
What expenses qualify for the exemption?
LTA covers only actual travel expenses incurred within India. Depending on the nature of the journey, exemptions may be applicable for air fare, rail fare, or public transport fare, subject to specific limits outlined in the rules. The exemption applies solely to travel expenses and does not extend to other vacation-related costs.
What expenses are not covered?
Costs for hotel stays, meals, local sightseeing, shopping, and other incidental expenses do not qualify for the exemption. Additionally, international travel is not eligible, as the tax benefit is restricted to journeys within India.
How often can the exemption be claimed?
The Income Tax Rules permit employees to claim the exemption for two journeys within a block of four calendar years as announced by the government. If only one journey is claimed during a block, the remaining exemption can generally be carried forward to the first journey in the subsequent block, subject to applicable conditions.
Can the exemption be claimed for family travel?
This benefit may also extend to travel undertaken by qualifying family members, provided the conditions set out under the Income Tax Rules are met. The exemption is contingent upon the officially prescribed definition of ‘family’ and other relevant limits.
Are travel documents required?
Taxpayers should maintain travel tickets, boarding passes, and other relevant documents as proof of travel. Employers may request these documents before granting the exemption, and taxpayers should keep them handy in case they are needed during tax assessments or verifications.
Can you claim LTA while filing your ITR?
If the employer has considered the exemption after verifying the necessary documents, it will usually be noted in Form 16. Taxpayers should verify these details before filing their returns. Those intending to claim the exemption directly when filing their ITR should ensure they comply with all stipulated conditions and possess sufficient documentary evidence to support their claims.
